Terms & Conditions

These Terms & Conditions ("Conditions") supplement the Terms of Service and apply to your use of Habitifi. In the event of a conflict, the Terms of Service take precedence.

1. Acceptance of Terms

By accessing or using Habitifi, you confirm that you have read, understood, and agree to be bound by these Conditions, our Terms of Service, and our Privacy Policy. If you do not agree, you must not use the App.

3.1 Device Security

You are solely responsible for maintaining the security of the device on which Habitifi is installed. We are not liable for unauthorized access to your data resulting from inadequate device security.

3.2 Data Backups

We recommend regularly backing up your device through iCloud or iTunes. We are not responsible for data loss resulting from device failure, app removal, or lack of backups.

3.3 Accurate Use

The App's analytics, streak calculations, and insights are based on data you enter. The accuracy of these features depends on the accuracy and completeness of your entries.

4. Limitation of Liability

4.1 No Warranties

Habitifi is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding:

In no event shall MRC Labs be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App, even if we have been advised of the possibility of such damages.

4.3 Maximum Liability

Our total cumulative liability to you for all claims arising from or relating to the App shall not exceed the greater of: (a) the amount you paid for the App in the 12 months prior to the claim, or (b) $50 USD.

5. Service Changes

5.1 App Updates

We may release updates that modify, add, or remove features. Updates may be required for continued use. We will endeavor to maintain backward compatibility but cannot guarantee it.

5.2 Subscription Changes

We reserve the right to modify subscription pricing and features. Current subscribers will receive notice of changes. Price changes will not affect the current billing period.

5.3 Discontinuation

We may discontinue the App or any feature at our discretion. If we discontinue the App entirely, we will make reasonable efforts to provide notice and allow data export where technically feasible.

6. Termination of Use

6.1 Voluntary Termination

You may terminate your use at any time by deleting the App from your device. This will remove all locally stored data.

6.2 Involuntary Termination

We may restrict or terminate your access if you violate these Conditions or the Terms of Service, or if required by law.

6.3 Survival

Sections relating to limitation of liability, disclaimers, indemnification, and dispute resolution shall survive any termination.

7. Indemnification

You agree to indemnify, defend, and hold harmless MRC Labs, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses arising from your use of the App or violation of these Conditions.

8. Dispute Resolution

8.1 Informal Resolution

Before pursuing formal proceedings, you agree to attempt to resolve any dispute informally by contacting us at support@habitifi.com.

8.2 Governing Law

These Conditions are governed by the laws of the United States, without regard to conflict of law principles.

8.3 Arbitration

Disputes shall be resolved through binding arbitration. You waive any right to participate in a class action lawsuit or class-wide arbitration.

9. Severability

If any provision of these Conditions is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
