Welcome to Habitifi (the "App"). These Terms of Service ("Terms") govern your use of the Habitifi mobile application provided by MRC Labs ("we," "our," or "us").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Description of Service

Habitifi is a habit tracking application designed to help you:

Track habits and goals
Monitor progress with streaks and analytics
View insights about your habit patterns
Build positive routines through gamification

The App is available as a free version with limited features and as a premium subscription with additional features.

2. Eligibility

You must be at least 13 years old to use this App. If you are under 18, you represent that you have your parent or guardian's permission to use the App.

3. Account and Data

3.1 No Account Required

Habitifi does not require you to create an account. All data is stored locally on your device.

3.2 Your Responsibility

You are responsible for maintaining the security of your device, backing up your data, and any activity through your use of the App.

3.3 Data Loss

We are not responsible for any loss of data due to device loss, theft, damage, app deletion, operating system updates, or failure to back up your device.

4. Subscriptions and Payments

4.1 Premium Subscription

Habitifi offers premium subscriptions providing additional features including unlimited trackers, advanced analytics, and custom themes.

4.2 Automatic Renewal

Monthly and yearly subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. Manage subscriptions through iPhone Settings > Apple ID > Subscriptions.

4.3 Refunds

All purchases are processed by Apple. Refund requests must be made through Apple at reportaproblem.apple.com.

5. Acceptable Use

You agree NOT to:

Use the App for any illegal purpose
Attempt to reverse engineer, decompile, or disassemble the App
Remove or alter any proprietary notices
Interfere with or disrupt the App's functionality
Use the App in any way that violates these Terms

6. Health Disclaimer

Habitifi is designed for general wellness tracking and is NOT a medical device, a substitute for professional medical advice, or a treatment for any medical or mental health condition.

If you have concerns about addiction, mental health, or any medical condition, please consult a qualified healthcare professional. In emergencies, contact emergency services immediately.

7. Intellectual Property

The App, including its design, features, content, and code, is owned by MRC Labs and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license for personal, non-commercial use.

You retain ownership of content you create within the App (habit names, notes, etc.).

8. Privacy

Your privacy is important to us. Please review our Privacy Policy for information about how we handle your data.

9. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We do not guarantee uninterrupted or error-free operation.

10. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability shall not exceed the amount paid for the App in the 12 months preceding the claim.

11. Modifications

We reserve the right to modify or discontinue the App, change features or pricing, and update these Terms at any time. Continued use after changes constitutes acceptance. If you do not agree, stop using the App.

12. Termination

You may stop using the App at any time by deleting it. We may suspend access for conduct violating these Terms. Upon termination, your license ends and applicable sections survive.

13. Governing Law

These Terms are governed by the laws of the United States. Disputes shall be resolved through binding arbitration. You agree to resolve disputes individually and waive class action participation.

14. Apple-Specific Terms

These Terms are between you and MRC Labs, not Apple. Apple has no obligation to provide maintenance or support for the App. Apple is a third-party beneficiary of these Terms and may enforce them.
